{"id":5543,"date":"2022-12-08T21:07:15","date_gmt":"2022-12-08T20:07:15","guid":{"rendered":"https:\/\/somoslegales.es\/sentencia-pionera-a-catalunya\/"},"modified":"2024-11-14T21:16:58","modified_gmt":"2024-11-14T20:16:58","slug":"sentencia-pionera-a-catalunya","status":"publish","type":"post","link":"https:\/\/somoslegales.es\/ca\/sentencia-pionera-a-catalunya\/","title":{"rendered":"SENT\u00c8NCIA PIONERA A CATALUNYA"},"content":{"rendered":"<p>Gr\u00e0cies a la nostra advocada i directora jur\u00eddica, Olga Majoral Bustos, hem aconseguit que el Jutjat de Primera Inst\u00e0ncia i Instrucci\u00f3 n\u00fam. 1 del Prat de Llobregat condemni una gran tenidor a <strong>tornar a un particular la quantitat lliurada en concepte de reserva d&#8217;una compravenda<\/strong> per no haver obtingut el finan\u00e7ament bancari necessari per a l&#8217;adquisici\u00f3 de l&#8217;immoble. Per tant, a la pregunta de si he lliurat una reserva o arres per comprar un immoble per\u00f2 el banc no m&#8217;ha concedit la hipoteca, tinc dret a recuperar els diners? <strong>La resposta \u00e9s s\u00ed.<\/strong><\/p><p>En efecte, el client havia lliurat a una <strong>gran empresa immobili\u00e0ria<\/strong> (filial d&#8217;un conegut Fons d&#8217;Inversi\u00f3) la quantitat de 3.000 Euros en concepte de reserva d&#8217;una possible compravenda que finalment no es va poder fer atesa la negativa de les entitats banc\u00e0ries a concedir el finan\u00e7ament necessari al comprador per a l&#8217;adquisici\u00f3 del dit immoble. Davant la impossibilitat d&#8217;obtenci\u00f3 d&#8217;un pr\u00e9stec per al finan\u00e7ament de la compra de l&#8217;habitatge reservat, el client es va dirigir a aquest Fons d&#8217;Inversi\u00f3 reclamant la devoluci\u00f3 de la quantitat lliurada, si b\u00e9 la mercantil <strong>es va negar a tornar-li la reserva en considerar que aquesta facultat no es trobava expressament prevista al contracte.<\/strong><\/p><p>Davant d&#8217;aquestes circumst\u00e0ncies, el client es va posar en contacte amb l&#8217;advocada Olga Majoral Bustos, que despr\u00e9s d&#8217;analitzar i estudiar el cas, va recomanar al client demanar judicialment el Fons d&#8217;Inversi\u00f3 sobre la base de l&#8217;aplicaci\u00f3 anal\u00f2gica de <strong>l&#8217;article 621-49 del Llibre Sis\u00e8 del Codi Civil de Catalunya<\/strong> en virtut del qual: <em><strong>&#8221;Si el contracte de compravenda preveu el finan\u00e7ament de tot o part del preu per una entitat de cr\u00e8dit, el comprador, excepte pacte en contra, pot desistir del contracte si justifica documentalment al terme pactat, la negativa de l&#8217;entitat designada a concedir el finan\u00e7ament (\u2026) El desistiment del comprador obliga el venedor a la devoluci\u00f3 del preu que li ha estat lliurat&#8221;.<\/strong><\/em><\/p><p>Si b\u00e9 \u00e9s cert que el citat article al\u00b7ludeix al &#8221;contracte de compravenda&#8221; i en el cas del nostre client aquest no s&#8217;havia celebrat, sin\u00f3 que est\u00e0vem davant d&#8217;un &#8221;contracte de reserva&#8221;, pel que ha d&#8217;entendre&#8217;s per \u201ccontracte\u201d al qual al\u00b7ludeix la norma, cal manifestar que en la majoria dels casos les operacions immobili\u00e0ries de compravenda estan precedides de contractes preliminars o preparatoris com els de reserva, promesa, opci\u00f3, arres, etc.<\/p><p>La intenci\u00f3 del legislador catal\u00e0 \u00e9s precisament la de contemplar ex novo aquesta facultat en defensa de la part compradora. No s&#8217;ajustaria a aquesta finalitat una interpretaci\u00f3 literal del terme \u201ccontracte\u201d al\u00b7ludit a l&#8217;article 621-49 CCCat i referit a la compravenda. A aquest efecte, la nostra advocada entenia que quan la norma al\u00b7ludeix al contracte de compravenda, la interpretaci\u00f3 m\u00e9s adequada \u00e9s la de considerar que<strong> forma part del \u201ccontracte\u201d, no nom\u00e9s el contracte en si, sin\u00f3 tamb\u00e9 el conjunt d&#8217;actes conformadors de la relaci\u00f3 contractual de compravenda, com \u00e9s el contracte de reserva, arres, etc.<\/strong> I que, per tant, en una aplicaci\u00f3 anal\u00f2gica del precepte esmentat al cas del nostre client, aquest tenia dret a recuperar la quantitat lliurada en concepte de reserva.<\/p><p>Doncs efectivament, la tesi sostinguda per l&#8217;Olga Majoral Bustos va ser l&#8217;acollida pel Jutjat de Primera Inst\u00e0ncia i Instrucci\u00f3 n\u00fam. 1 del Prat de Llobregat, el qual ha reconegut l&#8217;aplicaci\u00f3 anal\u00f2gica de l&#8217;article 621-49 CCCat als contractes de reserva o arres i, per tant, el dret del comprador a recuperar la quantitat lliurada al venedor en cas d&#8217;impossibilitat d&#8217;obtenci\u00f3 de finan\u00e7ament o hipoteca. Segons la referida Sent\u00e8ncia:<\/p><figure class=\"wp-block-image size-full\"><img fetchpriority=\"high\" decoding=\"async\" width=\"850\" height=\"644\" src=\"https:\/\/somoslegales.es\/wp-content\/uploads\/2022\/12\/imatge.png\" alt=\"\" class=\"wp-image-5512\" srcset=\"https:\/\/somoslegales.es\/wp-content\/uploads\/2022\/12\/imatge.png 850w, https:\/\/somoslegales.es\/wp-content\/uploads\/2022\/12\/imatge-300x227.png 300w, https:\/\/somoslegales.es\/wp-content\/uploads\/2022\/12\/imatge-768x582.png 768w, https:\/\/somoslegales.es\/wp-content\/uploads\/2022\/12\/imatge-600x455.png 600w\" sizes=\"(max-width: 850px) 100vw, 850px\" \/><\/figure><p>Es tracta d&#8217;un <strong>pronunciament pioner<\/strong> ja que l&#8217;article 621-49 CCCat \u00e9s de creaci\u00f3 recent i, per tant, avui dia no existeix una jurisprud\u00e8ncia consolidada respecte als requisits exigits perqu\u00e8 se&#8217;n pugui invocar l&#8217;aplicaci\u00f3 i molt menys que estengui la facultat de desistir de la compravenda si es justifica degudament la negativa de l&#8217;entitat banc\u00e0ria a concedir el finan\u00e7ament, <strong>no nom\u00e9s a aquells casos en qu\u00e8 s&#8217;hagu\u00e9s fet el contracte de compravenda, sin\u00f3 tamb\u00e9 -com en el cas del nostre client- quan s&#8217;ha fet un contracte preliminar a la compravenda ja sigui de reserva o arres, reconeixent el dret del comprador a recuperar la quantitat lliurada per aquest concepte.<\/strong><\/p><figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\r\n<iframe title=\"Planta Baixa (TV3)\" width=\"1200\" height=\"675\" src=\"https:\/\/www.youtube.com\/embed\/j11HiTi8zKo?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture\" allowfullscreen><\/iframe>\r\n<\/div><figcaption class=\"wp-element-caption\"><em><em>El programa Planta Baixa (TV3) publica la noticia<\/em>.<\/em><\/figcaption><\/figure><p>Si et trobes en un cas similar, no dubtis a posar-te en contacte amb nosaltres.
